Terms and Conditions – Lured Inn Fishing

Lured Inn Fishing Pty Ltd (ACN 667 230 908) of Shop 5A, 230 Cranbourne-Frankston Road, Langwarrin VIC 3910 (hereinafter referred to as ‘We’ or ‘Us’ or ‘Our’), is conducting a trade promotion by way of a lucky draw (hereinafter referred to as the ‘Giveaway’) for individuals (hereinafter referred to as ‘Participant’ or ‘Participants’ or ‘Members’ or ‘Entrants’ or ‘Them’ or ‘You’ or ‘Your’).

The Giveaway

1. The Giveaway commences at 7.00 AEDT on 29th of July 2024 and concludes at 11 pm AEDT on the 26th day of August 2024 with the draw being conducted 27th day of August 2024. 

2. The Giveaway event, at which the winners for prizes will be drawn, will be conducted online via the livestream on the Lured Inn Fishing website and/or Lured Inn Fishing social media platforms (Facebook, instagram and YouTube) on the nominated day of every month at approximately 8pm AEDT.

3. Information on how to enter and prizes form part of the terms of entry.

4. Entry into the Giveaway is deemed acceptance of these terms and conditions.

5. If there is any inconsistency between these Terms and Conditions and anything else that refers to this competition, these Terms and Conditions will prevail.

Subscription Packages

6. You become a ‘Member’ if you subscribe to one of the following packages:
6.1. $10 one off payment – 1 entry in the Giveaway prize and 1 week access to our website;
6.2. $30 one off payment – 4 entry in the Giveaway prize and 1 month access to our website;
6.3. $50 one off payment – 10 entries in the Giveaway prize and 6 months access to our website;
6.4. $80 one off payment – 20 entries in the Giveaway prize and 10 months access to our website; or
6.5. $100 one off payment – 50 entries in the Giveaway prize and 10 months access to our website.

7. You become a ‘Loyalty Member’ if you subscribe to one of the following packages:
7.1. $9.95 monthly payment – 1 entry in the Giveaway each month and unlimited access to our website, including any reports and partner discounts;
7.2. $29.95 per month – 4 entries in the Giveaway each month and ultimate access to our website, including any reports and partner discounts;
7.3. $49.95 per month – 10 entries into the Giveaway each month and ultimate access to our website, including any reports and partner discounts.

8. Subscription packages and these terms and conditions may change from time to time at our direction.

Eligibility

9. Entry is open to all Australian residents, except South Australian residents, who are over the age of 18 who enter in accordance with these terms and conditions of entry, except for employees of Lured Inn Fishing and their immediate family. For the purposes of this clause, ‘Immediate family’ includes parents, spouses, domestic partners, siblings and children or any other person residing in the employee’s household.

10. To be eligible for the Giveaway you must purchase a subscription package to our website and become a member or Loyalty Member during the Giveaway period. Each subscription package entitles you to a certain amount of entries into the Giveaway at no additional cost.

11. The number of entries you receive into the Giveaway will depend on the subscription package that you have selected.

12. Loyalty Members will be entered into the Giveaway every month in accordance with the subscription package the Loyalty Member has selected.

13. Loyalty Members entries into the Giveaway are accumulative every month.

14. By purchasing a subscription, you have agreed to have read these Terms and Conditions and agree to be bound by them.

15. There is no limit on the number of participants and Loyalty members who enter during the Giveaway period.

Prizes

16. The Giveaway will consist of the following prizes:

• Fishing Tackle to the value of $2,500 or $2,000 cash.

17. The Winner/s of the prize will be chosen by lucky draw. Every entrant has an equal and fair chance of winning each prize.

18. The Winner/s of the prize will be announced on the Lured Inn Fishing website livestream. This livestream may also be broadcast live across our social media platforms.

19. The Winner/s shall be contacted via phone and email immediately after the Giveaway has been drawn.

20. The names of the Winner/s will be published on our website following the Giveaway draw and will remain on the website for a minimum period of 28 days.

21. The Winner/s will have 28 days to claim and collect their prize from XX.

22. If the winner/s cannot be contacted by phone, email or through social media sites within 28 days to claim the prize and arrange a date and time to collect the prize then the prize will be forfeited and the prize will then be redrawn and a new winner announced X weeks/months from the stated draw date at Xpm AEDT as per the procedure outlined in these terms and conditions.

23. Lured Inn Fishing will make all reasonable attempts to contact the prize winner/s during the 28-day time period.

Membership Terms

24. Subscriptions purchased through our website grants you access to all content, including videos and reports, on our website for the time period specified in the your subscription package.

25. You will also have access to any discounts with our partners during their subscription time period.

26. You can cancel your subscription at any time and switch between tiers of membership at any time.

27. Loyalty members may receive higher discount rates depending on their subscription package.

Refunds, Returns, Exchanges

28. The purchase of a subscription to our website enters you to win amazing Giveaways. Subscription packages purchased during a Giveaway are non-refundable.

29. Our goods and services come with guarantees that cannot be excluded under Australian Consumer Law. For major failures you are entitled to cancel your service contract with us; and a refund for the unused portion or compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods.

30. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service. Refunds or rectifications cannot be given for reasons such as change of mind or failure to properly understand these terms and conditions.

Representation and Warranties of the Participant

31. The Participant represents and warrants that it shall not contact any affiliate, employee, sponsor or partner of Lured Inn Fishing in order to manipulate the Contest results.

Privacy

32. Your privacy important to us and we are committed to ensuring that information held about you is secure and that your confidentiality is protected.

Disclaimer

By becoming a Member of Lured Inn Fishing the Participant agrees to enter the Giveaway and Agrees that:

34. Any and all disputes, claims and causes of action arising out of or in connection with the Giveaway and the promotional prizes shall be resolved individually without any form of class action;

35. Any claims judgments and awards shall be limited to actual out of pocket costs incurred in entering the Giveaway, but under no circumstances will Lured Inn Fishing be responsible for any legal fees;

36. Participants hereby waive all rights to claim punitive, incidental or consequential damage and any rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out of pocket expenses incurred in entering the Giveaway.

37. In no event will Lured Inn Fishing, their licensees, parents, affiliates, subsidiaries and related companies, their advertising or promotional agencies or their respective officers, directors, employees, representatives and agents, be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising from access to, or use of, this website, electronic or computer malfunctions, or entrant participation in this contest, even if Lured inn Fishing was advised of the possibility of such damages.

38. Lured Inn Fishing reserves the right to disqualify any Participant found to be tampering with or otherwise abusing any aspect of this Giveaway as solely determined by Lured Inn Fishing.

39. In the event the Giveaway is compromised by non-authorised human intervention, tampering or other causes beyond the reasonable control of Lured Inn Fishing, that corrupt or impair the administration, security, fairness or proper operation of the Giveaway, Lured Inn Fishing reserves the right to suspend, modify or terminate the Giveaway.

40. Any attempt by a Participant to deliberately damage the website or undermine the legitimate operation of this Giveaway is a violation of criminal and civil laws, and should such an attempt be made, Lured Inn Fishing reserves the right to seek damages from any such Participant to the fullest extent permitted by Law.

41. Lured Inn Fishing assumes no responsibility for any problems or technical malfunction of computer systems, servers, software, internet service provider, or e-mail systems, failure of any entry to be received on account of technical problems or incomplete, late, lost, damaged, illegible or misdirected electronic communications, or any combination thereof.

42. The Giveaway is void where prohibited or restricted by law, the administration, security, fairness or proper operation of the Giveaway, Lured Inn Fishing reserves the right to suspend, modify or terminate the Giveaway.

43. Any attempt by a Participant to deliberately damage the website or undermine the legitimate operation of this contest is a violation of criminal and civil laws, and should such an attempt be made, Lured Inn Fishing reserves the right to seek damages from any such Participant to the fullest extent permitted by Law.

44.
